On the surface, building regulations look like one set of rules that applies to any building. In practice, commercial and residential projects are assessed quite differently, and the differences are not just technical detail. They affect cost, timescale, and what your builder actually needs to know how to do.

Same Rulebook, Different Application
Building Regulations in England are organised into Approved Documents, labelled A through R, covering everything from structure and fire safety to ventilation and electrical safety. Both commercial and residential buildings are assessed against these documents, but the requirements within each one are often written specifically for domestic dwellings or specifically for buildings other than dwellings, and the two tracks genuinely diverge.
Approved Document L on energy efficiency, for instance, is split into separate volumes, one for dwellings and one for buildings other than dwellings. The standards, calculation methods, and compliance routes are different depending on which volume applies to your project, and applying the wrong one is not a paperwork technicality, it changes what you actually need to build.
Fire Safety
This is probably the area where the gap between commercial and residential is widest. Commercial buildings, particularly ones open to the public or with a lot of people moving through them at once, are assessed against a much more demanding standard for means of escape, fire compartmentation, and access for the fire service.
Residential buildings still need to meet serious fire safety standards, especially where flats or multiple units share a building, but a typical single family home extension is dealing with a smaller and more contained set of requirements than a shop, office, or public building of similar size. Where residential regulation has tightened significantly is on taller buildings. Anything classed as a higher risk building, generally residential buildings of 18 metres or more, or seven storeys, now sits under the Building Safety Regulator with its own separate approval process. That is a world away from what a standard house extension needs to satisfy, but it shows how residential fire safety has moved a long way from being the simpler cousin of commercial regulation in every scenario.
Accessibility
Part M of the Building Regulations deals with access to and use of buildings, and here the commercial standard is generally more demanding by default. Public and commercial buildings are expected to accommodate a much broader range of users with no prior knowledge of the building, so requirements around step-free access, door widths, accessible toilets, and signage tend to be stricter and more comprehensively applied.
Residential Part M requirements exist too, and new dwellings do have minimum accessibility standards, but there is more flexibility in how a private home meets them compared with a commercial unit that the public will walk into cold.
Sound Insulation
Sound transmission is a much bigger consideration in residential buildings that contain more than one dwelling, such as flats, than in most commercial premises. Where you have separate households living above, below, or beside each other, Building Regulations require testing to demonstrate that sound insulation between units meets a minimum standard, both for airborne sound and impact sound through floors.
Commercial buildings are not immune to acoustic requirements, particularly in mixed use developments or where noise sensitive activities are involved, but the wall by wall, floor by floor testing regime that applies to residential flats is specific to the residential sector and does not have a direct commercial equivalent in most standard projects.
Ventilation and Thermal Performance
Both sectors are covered by ventilation and energy efficiency rules, but the specific targets differ because the two Approved Document L volumes set different standards for dwellings and non-dwellings. Recent changes under the Future Homes Standard are specifically aimed at new residential dwellings, pushing them towards low carbon heating systems and higher levels of on-site renewable generation. Commercial buildings are covered by a parallel but separate set of targets under the non-domestic volume, reflecting the fact that a warehouse, an office, and a house all lose and generate heat in very different ways.
Ventilation strategy also tends to look different in practice. A tightly sealed, well insulated home increasingly needs mechanical ventilation with heat recovery to maintain air quality, which is becoming a standard specification on residential new builds. Commercial buildings, particularly larger ones, have generally used mechanical ventilation for longer as a matter of course, so this is one area where domestic regulation is catching up to where commercial practice already was.
Higher Risk Buildings and Regulator Oversight
Since the Building Safety Act 2022, taller residential buildings sit under an entirely different level of scrutiny than most commercial premises of a similar size. Buildings meeting the higher risk threshold go through a formal gateway process, with approval stages before design, before construction, and before occupation, overseen by the Building Safety Regulator rather than a standard local authority building control body.
This creates a genuine divide within residential regulation itself, between a two storey house extension, which is a straightforward domestic project, and a tall residential tower, which now sits under one of the most heavily regulated processes in the entire construction industry. It is not accurate to say residential regulation is universally lighter touch than commercial. It depends entirely on the scale and type of building.
Why This Matters in Practice
The practical upshot of all this is that a builder who knows domestic extensions inside out is not automatically equipped to deliver a commercial fit out, and the reverse is equally true. The compliance routes, the specific Approved Document volumes that apply, the testing requirements, and even the way building control assesses the finished work are genuinely different processes dressed up in the same regulatory language.
